U. S. District Court Judge Emmet G. Sullivan, who is, at least in theory, hearing the Mike Flynn case, (some say he is actually prosecuting the case now) has taken the highly unusual and perhaps unique step of hiring a high-profile lawyer to "help him" with his response to the appeals court order that he respond to Flynn's lawyers demand that he drop the charges against General Flynn.
Flynn's lawyers have asserted that Judge Sullivan has no legal right to hire a former federal judge to in effect prosecute the case after the DOJ has decided to drop it. Based on a recent Supreme Court decision plus tons of case law, that assertion seems to be spot on.
Flynn's lawyers are trying to have Sullivan removed from the case for clear bias. Among other thing he has publicly asserted that Flynn is a traitor.
