Regular readers or news junkies might remember the case of Kevin Ferguson of Anaheim, CA. Back in February of last year Ferguson, who lives in Anaheim, had a set-to with a bunch of teenagers who liked to use his front lawn for a shortcut. He was a LAPD officer.
At some time during the confrontation, which was much more than a shouting match, the officer pulled a gun and fired a shot into the ground. He then grabbed hold of one of the people involved in the confrontation, a 13-year old.
The family of the young man sued both the LAPD and the Anaheim PD, asserting that they took the young man into custody without an adequate investigation. Charges were never actually filed and Officer Ferguson has since left the LAPD. The Police Commission determined that Ferguson acted out of policy. He was not charged by Anaheim.
The family has dropped the lawsuit for fear that they would likely loose and be liable for legal fees from both cities and the former officer. The cell phone footage showing an actual fight between the officers and several teens might have had a lot to do with that.
