A Fairbanks man charged with three counts of sexual assault for having sex with an incapacitated woman in the Fairbanks Police Department vestibule reportedly told arresting officers he thought it would be "adventurous."
Devan Thomas Gage, 25, said he acted "really just out of boredom" and admitted it was a mistake, according to a criminal complaint filed Tuesday in Fairbanks court.
Gage was arrested at 4:30 a.m. Monday after an emergency dispatcher saw the assault through security cameras and alerted officers in the building.
According to the complaint, the surveillance footage shows Gage and a woman entering the police station vestibule at 3:56 a.m. They sit on a bench and appear to fall asleep for about half an hour, after which Gage gets up. The woman slumps over on her back with her legs hanging off the bench and her mouth open.
Gage begins fondling the woman, puts his hands down her pants and undoes his own pants. He fondles himself before forcing oral sex on the unconscious woman, according to the complaint.
After several minutes, Gage pulls the woman's pants down to her ankles and begins to have sex with her while she is still unconscious.
An officer responded to the scene and physically pulled Gage off of the woman. She fell to the floor and slowly regained consciousness. The woman appeared confused about what was happening and became emotional. She told the officer she never consented to have sex with Gage and couldn't have consented anyway because she was passed out, according to the complaint.
The woman was taken to Fairbanks Memorial Hospital for treatment.
Gage told police he was sober, didn't have any mental or medical problems and had been hanging out with the woman all night. Police found an empty bottle of Monarch vodka in Gage's pocket.
Gage registered a breath-alcohol content of 0.000. The woman registered a breath-alcohol content of 0.300, according to the complaint.
