Jose Inez Garcia-Zarate, who was found not guilty in the death of Kate Steinle in San Francisco in 2015, was found incompetent to stand trial on federal charges relating to the same case.
Garcia-Zarate admits to having physical possession of the gun when it fired, killing Ms. Steinle, but asserts he found the gun wrapped up in a shirt and when he picked it up it fired accidentally. He then threw it off the pier to keep it from shooting more. The assholes on the S. F. jury actually bought it.

According to The Mercury News:
A court evaluator concluded Jose Ines Garcia Zarate is not competent to stand trial on federal gun charges “because of a mental illness that is not presently being treated,” according to a court document from the US District Court in California.
Garcia Zarate, an undocumented immigrant, was acquitted of murder in the 2015 San Francisco Pier shooting of Kate Steinle, a 32-year-old medical device sales representative.
“If neither side disputes the evaluator’s conclusion, the Court wishes to explore … what efforts should be made locally to restore the defendant to competency through proper medication, as opposed to sending the defendant to a federal facility outside California,” according to court documents dated February 14.
Otherwise, a hearing may be required to explore Garcia Zarate’s competency, the court documents say.
A status conference has been set for February 19 to discuss next steps.
