Hannah Brumbles of Deer Island, OR. wanted to buy a rifle. WalMart would not sell her one, as she was "only" 18, citing a new policy concerning the sale of any firearm to any person under 21.
Ms. Brumbles initiated a complaint with the BOLI (Bureau of Labor and Indistries) in Oregon alleging a violation of Section 659A.403 (1) of the Oregon Revised Statutes. This law protects pretty much everybody on the planet against discrimination in Oregon with regards to a bunch of stuff including age, with two exceptions, the purchase of alcohol and the purchase of weed. Firearms are neither.
The BOLI issued a preliminary ruling in her favor on August 21. She is asking $150,000 in damages, the same amount that BOLI fined a bakery for refusing to bake a cake for a same-sex couple. WalMart offered $150. BOLI is suggesting a settlement of $5,000.
The matter is set for a formal hearing in November. The policy is still in place even though it is a clear violation of law.
