SCOTUS has yet to rule on the notorious Colorado Baker case. However, a California court has just ruled that a Bakersfield bakery had a free-speech right to turn down a lesbian couple that wanted a wedding cake.
Kern County Superior Court Judge David Lampe said on Monday that a wedding cake is, to some extent, an artistic expression. The judge ruled specifically that the baker's rights under the First Amendment outweigh whatever interest the state may have in the matter. The judge specified that the baker could not refuse to sell the lesbian couple a cake that was already made and cut in the case for sale to the general public, but could refuse to make a custom cake.
